J. Elizabeth Portraiture Terms & Conditions

ABOUT THESE TERMS:
These terms apply to all sessions, orders and certificates from J. Elizabeth Portraiture, 3435 Ocean Park Blvd, Suite 210, Santa Monica, CA 90405. By booking a session, placing an order or redeeming a certificate, you agree to them. Questions about anything here: hello@jelizabethportraiture.com or (310) 579-9706.
RECORDING:
Outside cameras, including smart phones, tablets or otherwise, as well as any other recording devices are not permitted to be used for recording or photographing at your session. We kindly ask that this policy is also shared with your spouse, partner and any guest that will be joining you in studio.
DRESS CODE:
Because this experience is such a special event, we encourage our clients to treat it as such. Our Dress Code requires that all clients come dressed in the specifications of the Dress Code listed on the website. Clients in an inappropriate wardrobe will be required to reschedule. Clothing that is inappropriate includes but is not limited to: ripped jeans, shorts, t-shirts, sweatshirts, sneakers, khaki’s and workout attire of any kind.
PARTIAL FAMILIES:
We do not photograph ‘incomplete families,’ where one family member is not able to attend the portrait session but wants to attend at another time. We are more than happy to reschedule a new appointment for you when you are all together. J. Elizabeth Portraiture reserves the right to refuse service if the entire family does not attend the photo session and design session. J. Elizabeth Portraiture requires both parents (when applicable) to attend the session.
INDIVIDUAL CHILDREN/PET PORTRAITS:
Children and Pets can be photographed separately from their parents/pawrents AFTER the entire family has been photographed together. Children and Pets photograph more naturally and relaxed after they’ve warmed up to the process with their parents/pawrents first. Please make sure the entire family is prepared and dressed for the session. Our full Pet Policy is published on the website and applies to every session involving a dog.
EXTENDED FAMILY POLICY:
Extended families are deemed to be groups larger than 8. Different prices apply so please contact the studio for a current quote. Extended family bookings are taken at the discretion of the photographer and require an in-studio consultation to make a booking. Prize certificates are not available for extended family sessions.
ATTENDANCE:
We reserve 2 hours for your session. Please arrive approximately 10-15 minutes before your session start time. A late start will result in a shorter photography session and/or may be required to reschedule for another day.
APPOINTMENT HOLDING DEPOSITS:
A $300 deposit secures your session date and time. Your deposit is returned to you at your Design Session, or applied to your artwork order if you prefer, provided you attend both your Photography Session and your Design Session at the times booked.
The deposit is only forfeited if you do not attend and do not tell us in advance; if you cancel or reschedule with less than 14 days’ notice, having already rescheduled once; or if you arrive more than 15 minutes late and we are unable to run the session.
RESCHEDULING:
If you are unable to keep your appointment, you must let us know at least 14 days before your session. You may reschedule once at no cost.
NO-SHOW POLICY:
A “No-Show” is when an individual, family or couple does not attend their session and does not cancel or contact the studio. A $150 no-show fee applies in addition to the forfeited deposit. Where a prize or gift certificate was being redeemed, it is treated as used.
YOUR DESIGN SESSION AND YOUR ORDER:
Your Design Session is where you view your portraits and choose your artwork. Everyone involved in the decision needs to be there, because your images are retired after this appointment.
Orders are placed at the Design Session. You may change or cancel your order at any time before production begins. Once we have started making your artwork it is custom to your selections and can no longer be changed or canceled, other than as set out under REFUNDS AND CANCELLATIONS below. We will tell you when production starts.
PRODUCTION AND DELIVERY:
Every piece is made by hand to order. Our Classic finish is hand rendered and sealed; our Museum and Embellished Museum finishes are rendered as paintings and hand completed in oils, so how long your artwork takes depends on the finish, the size and the level of hand embellishment you choose.
When you place your order we will confirm your estimated completion date in writing, and we will keep you updated if anything changes. Your order is not charged as complete until your artwork is finished and dispatched.
Once dispatched, delivery within the United States typically takes a further 7 to 10 business days by UPS, USPS or FedEx.
Every portrait is created individually for you. Variation in artistic style, color, texture and composition is part of hand-finished work and is not a defect.
REFUNDS AND CANCELLATIONS:
We want you to be delighted with your artwork.
Before production begins: cancel for any reason and receive a full refund, including your deposit.
After production begins: because each piece is made to your specification, orders cannot be canceled or refunded. This does not affect your rights where an item arrives damaged, defective, or is not what you ordered.
If something is wrong: contact us at hello@jelizabethportraiture.com within 14 days of delivery. We will repair, remake or refund the piece. Where a remake is not possible, we will refund it.
Nothing in these terms limits any right you have under applicable federal or state consumer law.
PAYING BY INSTALLMENTS OR THIRD-PARTY FINANCING:
If you pay using a third-party financing or installment provider, your agreement for the credit is with that provider, not with J. Elizabeth Portraiture. Their terms, eligibility criteria and disclosures apply, and we cannot tell you whether you will be approved or on what terms.
Where a refund is due, we process it back through that provider against your loan or plan. We do not refund financed purchases as cash or as studio credit. A refund reduces or clears what you owe the provider. Please continue making any payments they ask for until they confirm the adjustment.
RESOLVING A PROBLEM:
If you are unhappy with a charge, please contact us first at hello@jelizabethportraiture.com. Almost everything is sorted out quickly and directly. If we cannot resolve it together, you remain free to raise it with your bank, card issuer or financing provider.
REVIEWS AND FEEDBACK:
We welcome honest feedback, publicly or privately. Nothing in these terms restricts your right to review J. Elizabeth Portraiture, and we will never ask you to take down a review as a condition of service or of resolving a complaint. PURCHASED GIFT CERTIFICATES:
These are certificates you or someone else has paid for. They do not expire and retain their full value. They are redeemable towards a session and artwork at J. Elizabeth Portraiture. Where a small balance remains after redemption, we will cash out that balance on request where required by California law. They may be transferred to another person. To redeem, contact the studio to book. Standard deposit and scheduling terms apply.
PRIZE AND PROMOTIONAL CERTIFICATES:
These are certificates awarded free of charge, including competition prizes and promotional offers. Different rules apply because nothing was paid for them.
The session must be booked before the expiration date shown on the certificate and taken within 3 months. They are non-transferable and not redeemable for cash or any cash equivalent. One per household in any 24 month period, and the recipient must not have redeemed a prize or promotional certificate with us in the previous 24 months, calculated from the previous sitting date. They cannot be combined with any other offer, prize or promotion, and only one may be used at a time. They cover studio portraiture only, not other types of photography, not framing, and not artwork from a previous session. Both parents attend where applicable.
Prize and promotional certificates entitle the holder to a single appointment. If you need to change it, tell us at least 14 days ahead. At management’s discretion we may reschedule and carry the certificate and deposit forward.
All sessions are photographed, designed and completed at our studio, 3435 Ocean Park Blvd, Santa Monica, CA 90405, and any reshoot happens there too.
DIGITAL FILES AND COPYRIGHT:
Under the copyright laws of the United States, J. Elizabeth Portraiture is the copyright owner of all images created at our studio. Purchasing artwork gives you ownership of the physical pieces and the right to display and enjoy them personally. It does not transfer copyright. Digital files are available as an add-on to an artwork order where offered. We are not otherwise obliged to supply digital files. Where a session forms part of a prize or gift certificate, copyright in the images belongs to J. Elizabeth Portraiture.
ARTISTIC CONTROL AND REFUSAL OF SERVICE:
We retain artistic control over the design and content of each session, and may decline to create particular styles, sizes or combinations where we believe the result would not meet our standards. We may refuse or discontinue service where doing otherwise would disrupt our staff or the normal operation of the studio.
FACEBOOK/INSTAGRAM (META) PROMOTIONS:
By entering a promotion through Facebook or Instagram, you acknowledge it is in no way sponsored, endorsed or administered by, or associated with, Meta. Selections are made periodically and we may select and gift applicants daily, weekly or monthly. One promotional offer per household in any 24 month period. Promotional values cannot be combined.
SMS NOTIFICATIONS & CONSENT:
By submitting your information and opting in, you consent to receive SMS notifications, reminders and, where you have selected it, occasional marketing messages from J. Elizabeth Portraiture. Message frequency may vary. Message and data rates may apply. Text ‘HELP’ for assistance. Reply ‘STOP’ to unsubscribe.
We use SMS to follow up on inquiries, confirm appointments, send session details and share relevant information. Promotional messages go only to people who have explicitly opted in.
PRIVACY AND GOVERNING LAW:
Our handling of your personal information is set out in our Privacy Policy. These terms are governed by the laws of the State of California. Where you live in another state, any consumer rights you have under that state’s law continue to apply.
